2. Scope of application

These General Conditions of Sale (GCS) govern all sales concluded via the website www.diamstar.co, between DIAMSTAR and any adult consumer within the meaning of the Consumer Code.

Any order implies full and complete acceptance of these T&Cs.

3. Products

DIAMSTAR sells natural and synthetic diamonds , unmounted, accompanied by a certificate of authenticity issued by an independent laboratory.

Descriptions, weight, color, purity, shape, and engraving number are indicated for each product. Photos are not contractually binding.

4. Price

Prices displayed are in euros (€), all taxes included (TTC), excluding any delivery charges.

Prices are subject to change at any time without notice. The price charged is the price in effect at the time the order is validated.

DIAMSTAR reserves the right to refuse any suspicious or abnormal order or in the event of a previous dispute.

6. Payment

Payment for orders on the website www.diamstar.co is made online, at the time of ordering, via a secure connection (HTTPS protocol and SSL encryption).

The accepted payment methods are as follows:

• Bank card (Visa, Mastercard, American Express) via the Stripe or Shopify Payments platform

• Bank transfer (on request, only for certain amounts – instructions sent by email)

The order will only be considered confirmed upon actual receipt of full payment.

DIAMSTAR reserves the right to cancel any order in the event of suspected fraud, illicit use of payment methods, or payment incidents.

No shipment will be made before payment has been validated by the platform concerned.

An electronic invoice is sent to the customer by email once the order has been validated.

7. Cancellation

Any order placed on the website www.diamstar.co is firm and final upon validation and payment.

7.1 Before shipment

A cancellation request can be made by email to info@diamstar.co, before the order is shipped.

DIAMSTAR reserves the right to accept or reject this cancellation depending on the order's readiness. If the cancellation is accepted, a refund will be issued within 14 days.

7.2 After shipment

An order that has already been shipped cannot be cancelled. However, if eligible, the customer may exercise their right of withdrawal under the conditions set out in Article 9.

7.3 Products not eligible for cancellation

Any order for a personalized diamond (engraving, special selection, custom request) cannot be cancelled, in accordance with article L221-28 of the Consumer Code.

8. Delivery

Shipping location: All orders are shipped from Paris, France, in secure and discreet packaging.

Delivery zones: Mainland France and the European Union (Germany, Austria, Belgium, Bulgaria, Cyprus, Croatia, Denmark, Spain, Estonia, Finland, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Monaco, Netherlands, Poland, Portugal, Czech Republic, Romania, Slovakia, Slovenia, Sweden, Monaco). Deliveries outside the European Union are available upon request only.

Shipping method: Secure delivery, with hand-to-hand signature upon receipt when applicable, and insurance adapted to the value of the merchandise.

Timeframes: Delivery times are provided for information purposes only. Delays cannot give rise to any compensation.

Customs duties and local taxes: No customs duties apply to shipments within France and the European Union. For deliveries outside the EU (upon request), customs duties or local taxes may apply and are fully borne by the customer.

Customs blockage or refusal: DIAMSTAR cannot be held responsible for any blockage, seizure, delay, or refusal of the merchandise by the customs authorities of the destination country.

No claim or refund will be accepted in such cases, and no reimbursement will be issued if the goods are held or destroyed due to local regulatory reasons.

9. Right of withdrawal

9.1 Time limit

In accordance with article L221-18 of the Consumer Code, the customer has a 14-day deadline to exercise his right of withdrawal.

9.2 Exclusions

According to article L221-28, the right of withdrawal does not apply to products:

• Personalized or engraved

• Whose value depends on fluctuations in the financial market

• Altered, worn or not returned in their original condition

9.3 Return after expertise

Before any return, the customer is invited to contact customer service in advance by email at: info@diamstar.co

All returns are subject to prior assessment by DIAMSTAR, or a partner laboratory, in order to:

• Check the authenticity and integrity of the stone

• Check the condition of the certificate and packaging

Reimbursement will only be made in the event of full conformity with the delivered product.

9.4 Return costs

Return costs and insurance are the responsibility of the customer.

10. Legal guarantees

In accordance with Articles L217-4 et seq. of the Consumer Code, and Articles 1641 et seq. of the Civil Code:

• The customer benefits from the conformity guarantee for 2 years

• And the guarantee against hidden defects

Complaints must be accompanied by specific evidence (photos, report, certificate) and addressed to info@diamstar.co.

Any return requires an expert appraisal of the disputed product.

11. Limits of liability

DIAMSTAR cannot be held responsible:

• Consequences of improper handling or storage by the customer

• Loss, theft or damage after delivery

• Cases of force majeure (strike, disaster, war, cyberattack, etc.)

• A customer error when ordering (address, choice of product, etc.)

• Indirect or immaterial damage (loss of business, financial loss)

DIAMSTAR's liability is strictly limited to the amount of the order.

12. Intellectual Property

The entire website www.diamstar.co is the property of DIAMSTAR.

Any partial or total reproduction is strictly prohibited without written authorization.

13. Personal data

The data collected is used for order processing and customer relationship management, in compliance with the GDPR.

The customer can exercise his rights (access, rectification, deletion) at any time via: info@diamstar.co

14. Applicable Law and Disputes

These T&Cs are governed by French law.

In the event of a dispute, an amicable solution will be sought. Failing this, the dispute may be brought before the competent courts.

In accordance with Article L.612-1 of the Consumer Code, the customer may contact a consumer mediator.
