2. Scope
These General Terms and Conditions of Sale (GTC) govern all sales concluded via the website www.diamstar.co between DIAMSTAR and any consumer of legal age within the meaning of the French Consumer Code.
Any order implies full and unconditional acceptance of these GTC.
3. Products
DIAMSTAR sells natural and lab-grown diamonds, unset, accompanied by an authenticity certificate issued by an independent laboratory.
Descriptions, weight, color, clarity, shape, and inscription number are specified for each product. Images are non-contractual.
4. Prices
Prices are displayed in euros (€) or in the customer’s local currency where applicable. The displayed price depends on the delivery country selected by the customer.
For orders delivered within France and the European Union, prices are shown inclusive of all taxes (VAT included).
For orders delivered outside the European Union, prices are shown excluding taxes. In such cases, French VAT does not apply. Import duties, local taxes, and customs clearance fees may be required by the destination country and remain the sole responsibility of the customer.
Prices may be modified at any time without prior notice. The price charged is the one in effect at the time the order is validated.
5. Orders
The ordering process includes:
- Selection of the diamond
- Validation of the cart
- Entry of personal information
- Payment
- Email confirmation
The customer is responsible for the accuracy of the information provided when placing the order, particularly the delivery address.
DIAMSTAR reserves the right to refuse any suspicious or abnormal order, or in the event of a prior dispute.
6. Payment
Payment is made online at the time of the order via a secure connection (HTTPS protocol and SSL encryption).
Accepted payment methods are:
• Credit card (Visa, Mastercard, American Express) via Stripe or Shopify Payments
• Bank transfer (upon request, for certain amounts only – instructions sent by email)
The order is considered confirmed only upon full receipt of payment.
DIAMSTAR reserves the right to cancel any order in the event of suspected fraud, unlawful use of a payment method, or payment incident.
No shipment will be made until payment has been validated.
An electronic invoice will be sent to the customer by email once the order is confirmed.
7. Cancellation
Any order placed on www.diamstar.co is considered firm and final once validated and paid. However, a cancellation request may be accepted by DIAMSTAR under the following conditions.
7.1 Before shipment
A cancellation request may be made by email to info@diamstar.co before the order has been shipped.
DIAMSTAR reserves the right to accept or refuse this request depending on the stage of order preparation. If accepted, the refund will be processed within 14 days.
7.2 After shipment
Once the order has been shipped from Paris, it cannot be cancelled. The customer may, if eligible, exercise their right of withdrawal under the conditions set out in Article 9.
7.3 Non-eligible products
Orders for customized diamonds (engraving, specific selection, bespoke requests) cannot be cancelled, in accordance with Article L221-28 of the French Consumer Code.
8. Delivery
Place of shipment: All orders are shipped from Paris, France, in secure and neutral packaging.
Delivery areas: Germany, Austria, Belgium, Bulgaria, Canada, Cyprus, Croatia, Denmark, Spain, Estonia, United States, Finland, mainland France, Greece, Hong Kong, Hungary, Ireland, Italy, Japan, Latvia, Lithuania, Luxembourg, Malta, Monaco, Netherlands, Poland, Portugal, Czech Republic, Romania, United Kingdom, Singapore, Slovakia, Slovenia, Sweden, Switzerland.
Shipping method: Secure delivery via specialized carriers, with signature upon delivery where applicable, and insurance adapted to the value of the goods.
Delivery times: Delivery times are provided for information purposes only. DIAMSTAR cannot be held responsible for delays attributable to the carrier or administrative procedures.
Customs duties and local taxes: No customs duties apply for shipments within France and the European Union. For deliveries outside the European Union, customs duties, local taxes, or clearance fees may apply and are entirely borne by the customer.
Customs blockage or refusal: DIAMSTAR cannot be held responsible in case of blockage, seizure, delay, or refusal of the goods by customs authorities. No claim will be accepted and no refund will be issued if the goods are held or destroyed for regulatory reasons, except where otherwise required by law.
9. Right of Withdrawal – European Union
9.1 Period
In accordance with Article L221-18 of the French Consumer Code, the customer has 14 days to exercise their right of withdrawal.
9.2 Exclusions
In accordance with Article L221-28, the right of withdrawal does not apply to:
• Customized or engraved products
• Products whose value depends on financial market fluctuations
• Products that have been altered, worn, or not returned in their original condition
9.3 Return and inspection
Before any return, the customer must contact customer service at info@diamstar.co.
All returns are subject to prior inspection by DIAMSTAR or a partner laboratory to verify the authenticity and integrity of the diamond and to check the condition of the certificate and packaging.
A refund will only be issued if the product is returned in perfect conformity with its original condition.
9.4 Return costs
Return shipping and insurance costs are borne by the customer.
9.5 Melee diamonds
DIAMSTAR melee diamonds are prepared, calibrated and packaged on demand according to the specifications of each order (selected size, color, clarity and quantity).
Due to the nature of these products, their individualized preparation, and the traceability and quality control requirements involved, return requests concerning melee diamonds may only be accepted on an exceptional basis and exclusively after prior approval from DIAMSTAR.
Any potential return must strictly concern a complete lot that is unused, unhandled, preserved in its original sealed parcel paper, and subject to a thorough gemological and quality inspection.
DIAMSTAR reserves the right to refuse any return showing signs of handling, alteration, use, opening of the sealed parcel paper, mixing, or any inconsistency with the lot originally shipped.
10. Right of Withdrawal – Outside the European Union
10.1 No right of withdrawal
For all orders delivered outside the European Union, no right of withdrawal applies. All sales are considered final once shipped.
10.2 Final nature of the order
By validating the order, the customer acknowledges that it is non-cancellable and non-refundable once shipped, regardless of the reason, including refusal of delivery.
10.3 Duties and taxes
Orders are invoiced excluding French VAT. Import duties, local taxes, and customs clearance fees may apply and are the sole responsibility of the customer.
10.4 Refusal to pay or accept delivery
If the customer refuses to pay duties or accept delivery, the order remains final. No refund will be issued, even if the shipment is returned.
10.5 Customs intervention
DIAMSTAR cannot be held responsible for any customs-related issue. No compensation or refund will be granted in such cases.
11. Legal warranties
In accordance with French law, the customer benefits from a 2-year legal guarantee of conformity and protection against hidden defects.
Claims must include supporting evidence and be sent to info@diamstar.co.
12. Limitation of liability
DIAMSTAR cannot be held liable for improper use or storage by the customer, loss, theft or damage after delivery, force majeure events, customer errors, or indirect damages.
Liability is strictly limited to the order amount.
Proof of delivery is provided by the carrier, including signature where required or any other delivery confirmation.
13. Intellectual property
All content on www.diamstar.co is the property of DIAMSTAR. Any reproduction is prohibited without prior written consent.
14. Personal data
Data is processed in accordance with GDPR. The customer may exercise their rights via info@diamstar.co.
15. Applicable law and disputes
These GTC are governed by French law. An amicable solution will be sought first.
The designated mediator is CM2C – Centre de la Médiation de la Consommation de Conciliateurs de Justice.
